Terms & Conditions

The terms that apply when you use this website or take part in IMSA training programmes, workshops, championships and events.

These Terms & Conditions (“Terms”) govern your use of memorysportsindia.com (the “Website”) and your participation in the training programmes, workshops, trainer development, championships and events (together, “Programmes and Events”) offered by Indian Memory Sports Academy (IMSA), an initiative of Indian Memory Sports Foundation (“IMSA”, “we”, “us” or “our”).

By using the Website, or by enrolling in or registering for any Programme or Event, you agree to these Terms. If you enrol or register someone under 18 years of age, you agree to these Terms on their behalf as their parent or guardian. If you do not agree, please do not use the Website or our services.

1. Using The Website

You may use the Website for lawful, personal and non-commercial purposes. You agree not to:

  • use the Website in any way that breaks the law or infringes the rights of others;
  • submit false, misleading or impersonated information through any form;
  • attempt to gain unauthorised access to the Website, its servers or any connected system, or interfere with its security or operation;
  • introduce viruses, malware or other harmful code;
  • send spam, or use automated tools to copy, scrape or collect content or personal information from the Website; or
  • use the Website to harass, abuse or harm any person.

We may restrict or block access to the Website for anyone who breaches these Terms.

2. Intellectual Property

Unless otherwise stated, all content on the Website and in our Programmes and Events — including text, the IMSA name, logo and brand, graphics, illustrations, photographs, videos, training materials, worksheets, practice resources, scoring guides and competition materials — belongs to IMSA or is used with permission, and is protected by copyright and other intellectual property laws.

You may view the Website and share links to its pages. You may not copy, reproduce, republish, modify, distribute or sell our content or materials, or use them for commercial purposes or to conduct your own training or competitions, without our prior written permission. The names, logos and trademarks of other organisations belong to their respective owners.

3. Enquiries And Communications

When you contact us through the Website, by email, by phone or on social media, please provide accurate information. We aim to respond to all genuine enquiries, but we do not guarantee a response within any particular time. Please do not send confidential or sensitive information through the contact form.

4. Training Programmes And Workshops

  • Programme details — including content, duration, schedule, mode (online or offline), venue and fees — are communicated for each programme and may be customised to the learner’s requirements. The information on the Website is a general description only.
  • An enrolment is confirmed only when IMSA has confirmed it and any applicable fee has been paid.
  • We may reschedule sessions, change the venue or mode of delivery, or assign a different trainer where necessary. We will inform you of such changes in advance wherever possible.
  • Training materials are for the enrolled participant’s personal use only and may not be shared, copied or sold.
  • Online sessions may not be recorded, screenshotted, streamed or shared without our written permission.
  • Participants are expected to attend on time, practise as advised and behave respectfully towards trainers and other participants. We may remove a participant whose conduct is disruptive, abusive or unsafe, without a refund.
  • Completing a programme does not guarantee any particular result (see our Disclaimer).

5. Trainer Development

Admission to the Trainer Development pathway is at IMSA’s sole discretion and is subject to application, screening, training, assessment and ongoing evaluation. Taking part does not automatically entitle anyone to a certificate, to be listed as an IMSA trainer, or to use the IMSA name, logo or materials. Any authorisation to train on behalf of IMSA will be given in writing, may be subject to separate terms, and may be withdrawn.

6. Championships And Events

  • Official information prevails. Each championship or event is governed by its official announcement, rules and instructions. Please read them carefully before registering.
  • Registration. A registration is complete only when the required details and any applicable fee have been received and IMSA has confirmed it. Registrations may close early if places are filled.
  • Eligibility and age categories. Participants must meet the eligibility requirements of the event and provide accurate information, including their date of birth. We may ask for proof of age or identity. Providing false information may lead to disqualification and the withdrawal of any results or awards.
  • Rules and officials. Participants must follow the competition rules and the instructions of the officials at all times, including the rules on entry and exit, communication, permitted materials, electronic devices, and photography or recording during competition sessions.
  • Fair play. Any conduct that compromises the fairness or integrity of the competition may result in penalties or disqualification.
  • Results and appeals. Results are determined according to the scoring methodology of each discipline. Any query or appeal must be raised through the official procedure and within the time limits announced for that event. After this process, the decision of the officials or appeals committee is final.
  • Changes. We may change the date, venue, schedule, format, disciplines, categories or awards of an event where necessary. If an event is rescheduled, registrations remain valid for the new date.
  • Travel and costs. Participants are responsible for their own travel, accommodation, meals and other personal expenses, unless the official information states otherwise.
  • Minors. Participants under 18 years of age must be registered by a parent or guardian, who is responsible for their supervision before and after competition sessions.

7. Fees, Payments And Refunds

  • Fees for Programmes and Events are as stated in the official information or confirmation provided for each Programme or Event. Applicable taxes and payment charges, if any, will be shown or communicated at the time of payment.
  • All fees are non-refundable and non-transferable, unless the official information for that Programme or Event states otherwise.
  • No refund is given for non-attendance, late arrival, partial attendance or withdrawal, or for removal or disqualification due to a breach of the rules or these Terms.
  • If IMSA cancels a Programme or Event and does not offer an alternative date or arrangement, we will refund the fee paid for it. Refunds are made to the original payment method, or as otherwise agreed, within a reasonable time.
  • If a Programme or Event is rescheduled, your enrolment or registration is carried forward to the new date.

8. Photographs, Video And Media

Photographs and video recordings may be taken at our Programmes and Events. By taking part, participants (and parents or guardians on behalf of minors) permit IMSA to capture and use these images and recordings, together with participants’ names and results, without payment, on the Website, on social media and in promotional, educational and media materials related to Memory Science and Memory Sports.

If you do not want a participant to be photographed or featured, please inform the organisers at registration or before the event. You may also ask us to remove a photograph or video from our Website or social media, as explained in our Privacy Policy.

9. Health, Safety And Personal Belongings

Participants take part in Programmes and Events at their own risk. Please tell us in advance about any medical condition, disability or special requirement that may affect participation, so that reasonable arrangements can be considered. Participants are responsible for their own belongings, and IMSA is not responsible for any loss, theft or damage to them.

10. Limitation Of Liability

To the fullest extent permitted by law, IMSA, Indian Memory Sports Foundation and their founders, directors, trainers, officials, volunteers and partners will not be liable for any indirect, incidental, special or consequential loss or damage arising from your use of the Website or your participation in any Programme or Event. Where liability cannot be excluded, our total liability in connection with any Programme or Event is limited to the fee you paid for it. Nothing in these Terms excludes any liability that cannot be excluded under applicable law. Please also read our Disclaimer.

11. Indemnity

You agree to indemnify IMSA against any claims, losses, damages and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website or our materials, or your violation of any law or of the rights of any other person.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

13. Links To Other Websites

The Website may contain links to third-party websites and social media platforms. We are not responsible for their content, policies or practices, and your use of them is subject to their own terms.

14. Events Beyond Our Control

We are not responsible for any delay, change, cancellation or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, epidemics, government orders, strikes, civil unrest, extreme weather, the unavailability of a venue, or the failure of power, internet or other services. In such cases, we will make reasonable efforts to reschedule or to offer an alternative arrangement.

15. Changes To These Terms

We may update these Terms from time to time. The latest version will always be available on this page, with the date it was last updated shown at the top. Your continued use of the Website, or your enrolment or registration after changes are published, means you accept the updated Terms. The Terms in force when you enrol or register apply to that Programme or Event.

16. General

If any part of these Terms is found to be invalid or unenforceable, the remaining parts will continue in full force. If we do not enforce any right under these Terms, that does not mean we have waived it. These Terms, together with the official information for a Programme or Event and our Privacy Policy, form the entire agreement between you and IMSA on these matters.

17. Governing Law And Jurisdiction

These Terms are governed by the laws of India. Any dispute arising from these Terms, the Website or any Programme or Event is subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana. We encourage you to contact us first, so that we can try to resolve any concern amicably.
